Business Terms and Conditions
These Terms and Conditions apply to business users of the Mise Systems Pty Ltd application and platform (the App). If you use the App as a customer, the customer Terms and Conditions apply instead.
1. Acceptance of Terms
By accessing or using the App, you agree to be bound by these Terms and Conditions.
2. Description of Service
The App provides business users with the ability to manage appointments, schedule staff, create services, take payments from clients, advertise rental space for sole traders within their space when available, have profiles for multiple business locations, and review business analytics.
3. Appointment Management
Business users can use the App to manage appointments, including scheduling, rescheduling, and canceling appointments.
4. Staff Scheduling
The App allows business users to schedule staff members for appointments and manage their availability.
5. Service Creation
Business users can create and customize services offered by their business through the App.
6. Payment Processing
The App facilitates payment processing from clients for appointments and services booked through the platform.
7. Rental Space Advertising
Business users can advertise rental space within their premises to sole traders through the App when available.
8. Multiple Business Locations
The App supports the creation of profiles for multiple business locations, allowing business users to manage appointments and services for each location separately.
9. Business Analytics
Business users have access to analytics and insights about their business performance through the App.
10. Third-Party Relationship
Mise Systems Pty Ltd acts as a third party between businesses and customers in relation to booking appointments and securing payment. Mise Systems Pty Ltd is not responsible for the quality of services provided by businesses or the conduct of customers.
11. User Conduct
Business users agree not to use the App for any unlawful or unauthorized purpose, including but not limited to: violating any applicable laws, infringing on the rights of others, or engaging in any activity that could harm the integrity or performance of the App.
12. Intellectual Property
All content and materials available on the App, including but not limited to text, graphics, logos, and software, are the property of Mise Systems Pty Ltd or its licensors and are protected by copyright, trademark, and other intellectual property laws.
13. Limitation of Liability
In no event shall Mise Systems Pty Ltd or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, arising out of or in connection with your use of the App.
14. Indemnification
Business users agree to indemnify and hold harmless Mise Systems Pty Ltd, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of or in connection with their use of the App.
15. Changes to Terms
Mise Systems Pty Ltd reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of the App after any such changes constitutes your acceptance of the new Terms and Conditions.
16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales.
